2. Acceptance of Terms
By installing, accessing, or using SmartCart Family, you automatically accept these Terms and Conditions, as well as our Privacy Policy.
If you do NOT agree with these terms, do NOT use the service.

• Have authorization from your parents/guardians (if you are a minor)
3. Service Description
3.1. What is SmartCart Family?
SmartCart Family is a grocery list management app for families consisting of two distinct parts: the app itself, which by design and philosophy does not require an internet connection (everything you do stays on your device), and this website, which does require an internet connection to access. We offer:
- Complete grocery management: Multiple stores, expense tracking, budgets, aisle mapping, statistics, and more
- Lucy educational character: Stories, tales, and adventures about healthy eating for kids
- 100% Offline: Works without an internet connection (the app)
- 7 languages: Spanish, English, Italian, French, German, Portuguese, and Chinese
- 60-day full trial: No credit card, no restrictions, all features
3.2. What SmartCart Family is NOT?
To avoid misunderstandings, we clarify that SmartCart Family:
- IS NOT an online store (we do not sell food products)
- DOES NOT guarantee exact prices (you enter prices manually)
- DOES NOT replace professional nutritional, medical, or pedagogical advice
- IS NOT a delivery service
- IS NOT a 100% free service (requires subscription after 60-day trial)
4. Plans and Pricing

4.1. Trial Period - 60 days FREE

• We do NOT ask for a credit card to start

• At the end of the 60 days, choose if you want to subscribe (monthly or annual plan)
• If you do not subscribe, you lose access to the app (your local data is kept for possible future reactivation)
• No commitments, no small print
4.2. Prices outside Spain
Prices adapt to the local currency depending on your country and current exchange rates:
- United Kingdom: £3.49/month or £24.90/year
- China: ¥29/month or ¥199/year
- Other countries (Euro): 3.99€/month or 29.90€/year
4.3. VAT Included
Prices shown are final. For customers residing in the European Union, prices include the applicable Value Added Tax (VAT) according to current regulations. For customers in other countries, prices are considered net and final.
5. Payments and Billing
5.1. Accepted Payment Methods
We process payments through PayPal, which accepts:
- CredDebit cards (Visa, Mastercard, American Express)
- PayPal Account
- Other payment methods depending on your country
5.2. Automatic Renewal
IMPORTANT: Subscriptions renew automatically:
- Monthly Plan: Charged every month on the same date
- Annual Plan: Charged every year on the same date
5.3. Price Changes
We reserve the right to modify prices under the following conditions:
- We will notify you 30 days in advance
- The new price DOES NOT affect your current subscription until the next renewal
- You can cancel before the renewal if you do not agree
5.4. Invoices
You will receive an invoice by email after each payment. If you need an invoice with specific data (company name, etc.), write to us at sales@smartcartfamily.com
6. Cancellations and Refunds
6.1. How to cancel your subscription
You can cancel your subscription at any time in two ways:
- From PayPal: Manage your subscriptions in your PayPal account
- By email to: info@smartcartfamily.com with the subject "Cancel subscription"
• You keep access to SmartCart Family until the end of the paid period
• Afterwards, you lose access to the app
• Your local data is NOT deleted (it stays on your mobile for possible future reactivation)
• You can reactivate whenever you want by subscribing again
6.2. Refund Policy
Waiver of right of withdrawal:
Having enjoyed 60 full days of free trial with unlimited access to all SmartCart Family features, you accept that you are fully aware of the service before making your purchase.
According to Article 103.m of the Spanish Consumer Law and EU Directive 2011/83, by completing your purchase:
• You expressly accept that the service begins immediately
• You voluntarily waive the legal right of withdrawal of 14 days
• You have had 60 days to evaluate the product before committing financially
Exceptional Refunds:
Although you have waived the right of withdrawal, we DO offer refunds in these justified cases:
- Serious technical error: The app does not work and we cannot fix it in 7 days
- Double charge: PayPal has charged you twice by mistake
- Fraud or unauthorized use: Someone made a purchase without your permission
- Major uncommunicated changes: We modified essential functions without notifying you
Cases where there is NO refund:
- Change of mind after purchase
- "I don't use it anymore" or "I don't need it"
- Problems with your device or operating system
- Not having read the price or contracted plan correctly
6.3. Exceptions (NO refund)
We do not offer refunds in these cases:
- Violation of these Terms (misuse, fraud, etc.)
- Problems with your device or operating system
- Change of mind after the refund period
6.4. Exceptional refund period
Approved exceptional refunds (only in the justified cases mentioned in 6.2) are processed within a maximum of 14 working days from approval and will appear on your original payment method via PayPal.

- Explain the justified reason (technical error, double charge, fraud, etc.)
- Provide evidence if possible (screenshots, receipts, etc.)
- We will evaluate each case individually within a maximum of 72 hours
7. Acceptable Use of Service
7.1. Permitted Uses
You can use SmartCart Family to:
- Manage your personal or family grocery lists
- Track your household expenses
- Share lists with your family/household
- Educational use with Lucy's stories
7.2. Prohibited Uses
You may NOT use SmartCart Family to:
- ❌ Resell, redistribute, or sublicense the app
- ❌ Reverse engineer or decompile the code
- ❌ Commercial use (store inventory management, etc.)
- ❌ Illegal or fraudulent activities
- ❌ Attempt to hack, overload, or damage the service
- ❌ Create fake or multiple accounts to abuse the trial period
8. Intellectual Property
8.1. Rights of SmartCart Family
SmartCart Family, its code, design, brand, logo, the "Lucy" character, and all content are the property of Francisco López Bermúdez and are protected by:
- Copyright
- Registered Trademarks (in process)
- Spanish and European intellectual property legislation
8.2. User License
By subscribing, you obtain a personal, non-exclusive, non-transferable license to use the app on your personal device(s).
8.3. Your data is yours
Despite our ownership of the app, your grocery lists, budgets, and entered data are 100% yours. You can export them whenever you want.
9. Limitation of Liability
9.1. App Functionality
We strive to offer excellent service, but we DO NOT guarantee:
- That the app works without interruptions or errors (bugs happen)
- Compatibility with all devices or operating system versions
- That your local data will survive a factory reset (make backups)
9.2. Prices and Calculations
• Differences between estimated and actual store prices
• Errors in your budget calculations
• Price changes in supermarkets
9.3. Educational Content (Lucy) and Parental Control
Lucy's stories, tales, and adventures are guiding educational content designed to teach children about healthy eating in a fun way. However:
We know that every family has its own values, beliefs, and educational criteria. Therefore:
• Informative page for parents: We explain in detail what content is available, how it works, and what values it transmits
• Mandatory preview: Parents can (and should) read/preview ALL stories before their children access them
• Individual activation/deactivation: Each story can be deactivated and made invisible to your children
• Total deactivation: You can completely hide the Lucy section if it does not fit your criteria
• Absolute respect: For educational, moral, religious, cultural, or any other criteria
What Lucy is NOT:
- DOES NOT replace professional medical or nutritional advice
- DOES NOT diagnose allergies, intolerances, or diseases
- DOES NOT prescribe personalized meal plans
- DOES NOT replace parental or school education
Recommendations:
- Read the Parental Control Guide before activating Lucy
- Preview content before your children see it
- Talk to your children about what they learn from Lucy
- Consult a pediatrician or nutritionist for questions about child nutrition
9.4. Indirect Damages
To the extent permitted by law, we are NOT responsible for indirect damages such as:
- Excessive purchases due to poor planning
- Forgotten products on your list
- Time lost if the app fails
- Data loss due to not backing up
9.5. Maximum Liability Limit
In any case, our maximum liability is limited to the amount paid for your subscription in the last 12 months.
10. Service Warranties
10.1. What we DO guarantee

• 100% offline operation
• Free updates to improve the app
• Email support in 7 languages
• Total transparency in changes and prices
10.2. No Implied Warranties
Except for the express warranties mentioned above, the service is offered "as is" without implied warranties of:
- Merchantability
- Fitness for a particular purpose
- Specific savings results
11. Service Modifications
11.1. Updates and Improvements
We may update SmartCart Family to:
- Fix errors (bugs)
- Improve existing features
- Add new features
- Adapt to new operating system versions
Important updates will be communicated in the app.
11.2. Removal of Functions
If we need to remove or significantly modify a function:
- We will notify you 30 days in advance
- We will explain the reason
- We will offer alternatives where possible
11.3. Service Closure (unlikely, but possible)
If for any reason we had to close SmartCart Family:
- Prior notice of 6 months
- Full refund of unconsumed annual subscriptions
- Tools to export all your data
12. Modifications to these Terms
We may update these Terms occasionally. When we do:
- We will publish the new version on this page
- We will update the date above
- Major changes: We will notify you by email 30 days in advance
- Minor changes: Effective immediately
13. Applicable Law and Jurisdiction
13.1. Applicable Legislation
These Terms are governed by Spanish law and applicable European regulations, including:
- GDPR (General Data Protection Regulation)
- LSSI (Information Society Services Law)
- Consumer and User Defense Law
13.2. Dispute Resolution
We prefer dialogue: If you have any problem or disagreement, contact us first at info@smartcartfamily.com. We will resolve 99% of cases by talking.
13.3. Jurisdiction
For any legal dispute that is not resolved amicably, both parties submit to the courts and tribunals of Spain corresponding to your domicile.

As a consumer in the EU, you have the right to use the European online dispute resolution platform:
